MORTGAGEE’S NOTICE OF FORECLOSURE SALE OF
REAL PROPERTY UNDER 12 V.S.A. SEC 4952 ET SEQ.

In accordance with the Judgment Order and Decree of Foreclosure entered July 22,
2019, in the above captioned action brought to foreclose that certain mortgage given
by George F. Silver to Chase Bank USA, N.A., dated August 1, 2007 and recorded in
Book 689 Page 308 of the land records of the Town of Stowe, of which mortgage the
Plaintiff is the present holder, by virtue of the following Assignments of Mortgage: (1)
Assignment of Mortgage from Chase Bank USA, N.A. to JPMorgan Chase Bank, NA
dated September 30, 2015 and recorded in Book 924 Page 147 and (2) Assignment
of Mortgage from JPMorgan Chase Bank, National Association to U.S. Bank, National
Association as Legal Title Trustee for Truman 2016 SC6 Title Trust dated August 15,
2019 and recorded in Book 1058 Page 78, both of the land records of the Town of
Stowe for breach of the conditions of said mortgage and for the purpose of foreclosing
the same will be sold at Public Auction at 250 Bullmoose Ridge Road, Stowe, Vermont
on March 13, 2020 at 11:00 AM all and singular the premises described in said
mortgage,
TO WIT:
THAT CERTAIN TRACT OR PARCEL OF LAND BEING IN THE TOWN OF
STOWE, VERMONT, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
STOWE COUNTY
BEING ALL OF THE SAME LANDS AND PREMISES CONVEYED TO GEORGE F.
SILVER BY WARRANTY DEED OF NELSON S. RILEY, III DATED MARCH 20, 1987
AND RECORDED IN BOOK 135 AT PAGE 166 OF THE STOWE LAND RECORDS.
THIS CONVEYANCE IS MADE SUBJECT TO AND WITH THE BENEFIT OF
EASEMENTS, RIGHTS-OF-WAY, CONDITIONS, RESTRICTIONS, AND OTHER
SUCH INTERESTS AS THE SAME MAY APPEAR OF RECORD, PROVIDED,
HOWEVER, THAT THIS PARAGRAPH SHALL NOT REINSTATE ANY SUCH
INTERESTS EXTINGUISHED HERETOFORE BY PROVISIONS OF THE VERMONT
MARKETALBE RECORD TITLE ACT AS SET FORTH IN TITLE 27 VERMONT
STATUTES ANNOTATED 601-606 AND ANY AMENDEDMENTS THERETO.

IS HEREBY MADE TO THE DEED(S) AND INSTRUMENT(S) RECITED HERSINBEFORE
AND THE DESCRIPTION AND REFERENCES CONTAINED THEREIN.

Reference is hereby made to the above instruments and to the records and
references contained therein in further aid of this description.
Terms of sale: Said premises will be sold and conveyed subject to all liens,
encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which
take precedence over the said mortgage above described.
TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a
certified check, bank treasurer's or cashier's check at the time and place of the sale
by the purchaser. The balance of the purchase price shall be paid by a certified
check, bank treasurer's or cashier's check within sixty (60) days after the date of sale.
The mortgagor is entitled to redeem the premises at any time prior to the sale by
paying the full amount due under the mortgage, including the costs and expenses
of the sale.
